Interpretation The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural. Definitions For the purposes of this Disclaimer: Company (also referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to The Unicorn Program, LLC, located in Wheeling, IL. Service refers to the Website, courses, video trainings, digital downloads, assessments, templates, PDU offerings, materials, and all related content provided by the Company. You (also referred to as the “participant” in this Agreement) refers to the individual accessing or using the Service, or the Company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Website refers to The Unicorn Program, accessible from https://theunicornprogram.thinkific.com or any affiliated domains. Terms and Conditions (also referred to as “Terms”) refers to this agreement governing access to and use of the Service. Professional Development Units (also referred to as “PDU” or “PDUs”) refers to the continuing education training hours recognized by credentialing bodies such as the Behavior Analyst Certification Board® (BACB®) for the maintenance of Registered Behavior Technician® (RBT®) credentials. Enrollment refers to the act of registering for, purchasing, or otherwise gaining authorized access to a course or educational offering provided by the Company.
The information contained on the Service is for informational and training purposes only. The Company assumes no responsibility for errors or omissions in the contents of the Service. In no event shall the Company be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice. The Company does not warrant that the Service is free of viruses, malware, or other harmful components and shall not be liable for any damage resulting from use of the Service.
The Unicorn Program provides educational and professional development content exclusively for informational and training purposes. The Company does not provide clinical, therapeutic, medical, psychological, behavioral health, supervisory, legal, tax, or other professional services through the Service. Participation in any course, program, training, professional development unit (PDU) offering, or use of any materials does not create a provider-client, therapist-patient, supervisor-supervisee, consultant-client, fiduciary, or other professional relationship between You and the Company. The content provided is not a substitute for individualized professional judgment, clinical supervision, treatment planning, or services delivered by appropriately licensed or credentialed professionals. You acknowledge and agree that You are solely responsible for the manner in which You interpret and apply the educational information provided.
The Company presents educational materials that may reference evidence-based practices, applied behavior analysis principles, clinical frameworks, ethical standards, and professional guidelines. However: • The Company makes no representations or guarantees regarding the effectiveness, appropriateness, or outcomes of applying any information presented. • The Company does not supervise, monitor, or oversee Your professional practice. • You remain fully responsible for ensuring that any implementation of techniques or strategies complies with applicable laws, licensing requirements, ethical standards, certification requirements, and supervisory obligations in Your jurisdiction. Use of the Service is at Your own professional discretion and risk.
Where PDUs are offered: • The Company endeavors to provide accurate documentation of course completion. • Participants are responsible for ensuring that completed coursework meets the requirements of their respective credentialing or regulatory body (including but not limited to the Behavior Analyst Certification Board® (BACB®)). • The Company does not guarantee approval, acceptance, renewal, or maintenance of any certification, licensure, or credential based solely on participation in the Service. You acknowledge that You are responsible for maintaining copies of all certificates and required documentation. The Company may retain course completion and documentation records for administrative and compliance purposes. The Company does not guarantee indefinite retention of documentation and participants are responsible for maintaining personal copies of all required records.
The Service is provided for educational enrichment only. The Company makes no guarantees regarding: • Certification exam results • Employment opportunities • Income generation • Professional advancement • Clinical outcomes • Mastery of skills All educational content is provided “as is” without warranties of any kind, express or implied.
To the fullest extent permitted by applicable law, the total liability of the Company and any of its suppliers under this Agreement, and Your exclusive remedy for all claims, shall be limited to the amount actually paid by You to the Company for the applicable Service. In no event shall the Company or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, including but not limited to damages for loss of profits, loss of revenue, loss of data or other information, business interruption, personal injury, loss of privacy, or any other damages arising out of or relating to: • Use of or inability to use the Service • Reliance on educational content • Professional or clinical decisions made by You • Errors or omissions in content • Loss of data or documentation • Use of third-party software or hardware in connection with the Service whether based on contract, negligence, tort, strict liability, or any other legal theory, even if the Company has been advised of the possibility of such damages and even if any remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to You. In such cases, liability shall be limited to the maximum extent permitted by law.
The Service may contain links to external websites that are not provided or maintained by or in any way affiliated with the Company. Please note that the Company does not guarantee the accuracy, relevance, timeliness, or completeness of any information on these external websites. The Company does not control, endorse, or assume responsibility for the accuracy, relevance, or reliability of content on external sites.
While the Company strives to ensure that content is accurate and current, the evolving nature of research, laws, regulations, and professional standards means that errors, omissions, or delays may occur. Unauthorized reproduction, distribution, modification, public display, or commercial use is strictly prohibited.
The Service may contain views and opinions expressed by instructors, contributors, or users, which do not necessarily reflect the official policy or position of any other author, agency, organization, employer or Company, including the Company. Where user-generated content is permitted, such content remains the sole responsibility of the individual who posted it. The Company is not liable for user-generated content and reserves the right to remove it for any reason.
